Nachahmungen beschäftigen die Bildschirmspielindustrie seit vielen Jahrzehnten – Anfang der 70er Jahre begonnen, in den 90er Jahren abgeebbt und seit einigen Jahren aufgrund der mobilen Plattformen wieder im Kommen. Vor allem der stete Aufstieg der Branche im 21. Jahrhundert macht Klonungen wieder rentabel. Durch die technische Fortentwicklung hat neben der Musik- und Filmindustrie vor allem die Bildschirmspielindustrie an Umsatz und Professionalität enorm zugelegt. Umso mehr Bildschirmspiele die Unterhaltungsbranche aufrollen,, desto wichtiger ist es für deren Entwickler und Hersteller, dass sie einen ausreichenden Schutz widerfahren. Die vorliegende Arbeit setzt sich mit diesem Thema auseinander und stellt sich die Frage, ob das aktuelle Urheberrecht genügend Schutz für Entwickler bietet. Es wird kurz auf die Geschichte und Entwicklung eingegangen, danach auf die einzelnen Werkarten die innerhalb eines Bildschirmspiels urheberrechtlichen Schutz genießen können, darunter vor allem auf den Unterschied zwischen Spielidee und Spielkonzept und ab wann eine Idee urheberrechtlichen Schutz genießen kann. Ein weiterer Schwerpunkt liegt auf den urheberrechtlichen Schutzmöglichkeiten vor Nachahmungen, mithin wird hier die aktuelle Rechtsprechung zu Bearbeitungen und Umgestaltungen betrachtet und auf Bildschirmspiele angewandt. Letztlich wird ebenfalls an praktischen Beispielen (u.a. Crush the Castle ./. Angry Birds) gezeigt inwiefern geprüft werden kann, ob eine Nachahmung vorliegt oder nicht. Hierfür wurden Prüfungskriterien entwickelt die auf jeden Fall anwendbar sind. Es gibt zudem auch einen Abschnitt über die anderen Gewerblichen Schutzrechte und inwiefern diese für einen Bildschirmspielschutz anwendbar wären. Besonders müssen jedoch die Anlagen hervorgehoben werden. Dort stelle ich nicht nur Spielmuster vor an denen sich mehr oder minder alle Spiele bis heute halten, gebe Prüfungsmerkmale für das Spielgenre und Spielkonzept vor und erkläre alle benutzten Spezialbegriffe in einem Glossar. Letztlich bietet die Arbeit einen breiten Rundumschlag zum urheberrechtlichen Schutz von Bildschirmspielen der sowohl für privat Interessierte, wie auch für in den Fachbereich tätige, oder die es werden wollen, viele interessante und Kompakt zusammengetragene Informationen liefert, die weit über eine übliche Bachelorarbeit hinausgehen.
